Omnilex summary

The Federal Supreme Court considered a revision request against its judgment of 31 May 2012. It held that the applicant's arguments concerned only the legal assessment of the case, in particular proportionality and investigation costs, and therefore did not establish any of the exhaustive revision grounds under Arts. 121-123 BGG. The Court therefore did not enter into the request. It also refused free legal assistance because the application had no prospects of success, and imposed reduced court costs of CHF 500 on the applicant in view of her financial situation.

Omnilex headnote

Arts. 121-123 BGG; revision of a Federal Supreme Court judgment is limited to the exhaustively enumerated statutory grounds and cannot serve to reargue the legal assessment of the case. Criticism directed solely against the previous legal appreciation, including proportionality considerations or the allocation of investigation costs, is inadmissible as a revision ground (consid. 1). Where the revision request is manifestly devoid of prospects, legal aid under Art. 64 BGG is to be refused; court costs are imposed on the unsuccessful applicant, with mitigation in light of financial circumstances under Art. 65 Abs. 2 BGG and Art. 66 Abs. 1 BGG (consid. 2).

Gegenstand
Gesuch um Revision des Urteils des Schweizerischen Bundesgerichts 6B_292/2012 vom 31. Mai 2012.

Das Bundesgericht zieht in Erwägung:

1.

Extracted by Omnilex

Key legal question

Whether the requirements for revision of a Federal Supreme Court judgment under Arts. 121-123 BGG were met.

Extracted holding

No revision ground was established; the application merely challenged the legal assessment of the case, which is inadmissible in revision.

Extracted reasoning

The statutory grounds for revision are exhaustive. The applicant's criticism of proportionality and costs attacked the prior legal assessment and therefore could not be examined in revision.

Key legal question

Whether legal aid should be granted for the revision application.

Extracted holding

Denied because the requested revision was hopeless.

Extracted reasoning

The application lacked any arguable revision ground, so the request was manifestly without prospects of success.

Key legal question

Allocation of court costs for the revision proceedings.

Extracted holding

Costs were imposed on the applicant, with due regard to her financial situation.

Extracted reasoning

As the application was unsuccessful, costs followed the outcome; the Court reduced them in light of the applicant's financial circumstances.
