Inadmissibility for insufficiently reasoned criminal complaint

6B_997/2008Federal Supreme Court / Criminal DivisionDec 20, 2008Inadmissible

Summary

X. challenged the decision of the Appellationsgericht of Basel-Stadt before the Swiss Federal Supreme Court in a criminal matter. The Court held that the complaint did not address the decisive reasoning of the cantonal decision and therefore failed to satisfy the federal requirements for reasoning. The complaint was not entered into under Art. 108 BGG. In view of the circumstances, the President waived court costs.

Regest

Art. 42 Abs. 2, Art. 106 Abs. 2 und Art. 108 BGG; requirements of substantiation for a federal complaint in criminal matters. A complaint must, in a reasoned manner, engage with the decisive considerations of the challenged decision; where the appellant merely repeats assertions or omits to address the ratio decidendi, the filing is inadmissible. The Federal Supreme Court examines the pleading ex officio only within the limits of the substantiation duty; failure to comply leads to non-entry in summary procedure under Art. 108 BGG (consid. 1). Costs may exceptionally be waived in the circumstances (consid. 2).

Urteil vom 20. Dezember 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Basel-Stadt, Binningerstrasse 21, Postfach, 4001 Basel,
Beschwerdegegnerin.

Gegenstand
