Omnilex summary

The Federal Court dismissed the criminal appeal against the cantonal decision confirming a no-entry order for insults and threats. It held that the complaint was filed after the three-month period because the relevant events occurred on 10 December 2015 and the complaint was filed on 11 March 2016. The appellant failed to show arbitrary assessment of the file, and no violation of the right to be heard was found because she had already been asked to clarify the facts in writing. Legal aid was refused and reduced court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 31 CP; complaint period for private criminal complaints; Art. 42 al. 1-2, 105 al. 1, 106 al. 2 and 109 al. 3 LTF; review of factual findings and arbitrariness. The Federal Court will not depart from the cantonal factual assessment unless the appellant substantiates a constitutionally defective finding. If the cantonal court could, without arbitrariness, conclude from the complaint and subsequent submissions that the decisive act occurred on a given date, a complaint lodged after expiry of the three-month period is untimely. No violation of the right to be heard arises where the party has already been invited to clarify her allegations in writing. Legal aid requires non-illusory prospects of success (Art. 64 LTF); losing parties bear the costs, which may be reduced according to financial circumstances (Art. 66 LTF).

Arrêt du 29 novembre 2016

Cour de droit pénal

Composition
MM. et Mme les Juges fédéraux Denys, Président,
Jacquemoud-Rossari et Oberholzer.
Greffière : Mme Gehring.

Participants à la procédure
X.________,
recourante,

contre

Ministère public central du canton de Vaud,
intimé.

Objet

The complaint was filed too late because the relevant events were found to have occurred on 2015-12-10 and the complaint was lodged on 2016-03-11.

The appellant did not show that the cantonal court had made an arbitrary assessment of the complaint and subsequent observations. The Federal Court accepted the cantonal finding and applied the three-month period under Art. 31 CP.

No violation was established.

She had already set out her account in the complaint and, after a request for clarification, in her observations of 2016-04-15.

Legal aid was denied because the appeal had no prospect of success.

Under Art. 64 LTF, assistance is excluded when the conclusions are plainly doomed to fail.

The appellant must pay reduced court costs of CHF 800.

As the losing party, she bears the costs under Art. 66 LTF, with a reduction reflecting her financial situation.
