Omnilex summary

X.________ challenged a Vaud cantonal decision converting CHF 800 in parking fines into 8 days' substitute custodial sentence. The Federal Supreme Court held that her submission did not meet the statutory reasoning requirement because it failed to explain any violation of law and instead only described her personal hardships and asked for leniency. The appeal was therefore not entered into. In view of her precarious financial situation, the court exceptionally waived judicial costs.

Omnilex headnote

Art. 108 al. 1 let. b LTF, art. 42 al. 2 LTF; admissibility of a federal appeal in simplified procedure for manifestly insufficient reasoning. The statement of grounds must, even succinctly, indicate in what respect the challenged decision violates federal law; mere appeals to equity, hardship, or personal circumstances do not satisfy the statutory burden of reasoning. Where such minimum substantiation is lacking, the court may declare the appeal inadmissible without examination of the merits (consid. 1-2). Exceptional waiver of costs may be justified by the appellant's poor financial situation (consid. 3).

Arrêt du 21 décembre 2007
Cour de droit pénal

Composition
M. le Juge Schneider, Président.
Greffier: M. Fink.

Parties
X.________,
recourante,

contre

Ministère public du canton de Vaud,
rue de l'Université 24, 1005 Lausanne,
intimé.

Objet

Faits:
A.

The appeal did not state, even briefly, how the cantonal decision violated the law.

Extracted reasoning

Under Art. 108(1)(b) and Art. 42(2) LTF, the appellant must briefly explain the alleged legal error; appeals relying only on pleas for leniency and personal hardship are insufficient.

Key legal question

Whether court costs should be charged to the appellant.
