Omnilex summary

The appellants challenged a St. Gallen decision concerning the non-opening of criminal proceedings. The Federal Court had previously ordered them to pay an advance on costs of CHF 1,000 within a fixed deadline and a grace period, warning that failure would lead to non-entry. As the advance was not paid, the court did not enter into the appeal under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellants, each bearing half with joint and several liability.

Omnilex headnote

Art. 108 BGG; non-payment of the ordered advance on costs within the set deadline and grace period results in non-entry into the appeal when the parties have been duly warned. The court may decide in summary procedure without examining the merits. Under Art. 66 para. 1 BGG, the unsuccessful appellants bear the court costs; joint and several liability may be ordered where several appellants act together.
