Omnilex summary

The appellant challenged a judgment of the Zug High Court in a traffic-rule offense case but failed to submit the challenged decision even after a deadline extension under Art. 42(5) BGG. The Federal Supreme Court therefore did not enter into the appeal under Art. 108 BGG. It also denied free legal aid because the appeal was hopeless, and it imposed court costs of CHF 500 on the appellant, reduced in view of his financial situation.

Omnilex headnote

Art. 42 Abs. 5 BGG, Art. 108 BGG; non-compliance with an order to cure a formal defect, in particular failure to file the challenged decision, leads to non-entry if the defect persists after warning and deadline extension. Free legal aid under Art. 64 BGG is excluded where the appeal is manifestly devoid of prospects. Court costs under Art. 66 Abs. 1 BGG may be imposed on the unsuccessful party, with due regard to financial circumstances under Art. 65 Abs. 2 BGG.

Urteil vom 29. November 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Zug,
An der Aa 4, 6300 Zug,
Beschwerdegegnerin.

Gegenstand

Key legal question

Whether the criminal appeal was admissible despite the missing attachment of the challenged decision.

Extracted holding

The appeal was not admitted because the defect was not cured within the extended deadline.

Extracted reasoning

After a warning under Art. 42(5) BGG and an extension of time, the appellant still did not submit the appealed decision among the attachments; under Art. 108 BGG the filing was therefore not examined.

Key legal question

Whether the appellant was entitled to free legal aid.

Extracted holding

Free legal aid was denied because the appeal had no prospects of success.

Extracted reasoning

Under Art. 64 BGG, legal aid requires non-frivolous claims; the court found the requested relief hopeless in view of the procedural defect.

Key legal question

Who bears the court costs.

Extracted holding

The appellant must bear the court costs, reduced in light of his financial situation.

Extracted reasoning

Costs were imposed on the unsuccessful appellant under Art. 66(1) BGG, with the fee set taking account of financial circumstances under Art. 65(2) BGG.
