Omnilex summary

The Federal Supreme Court did not enter into the appellant's complaint against the cantonal Anklagekammer's non-entry decision in an enforcement matter. It held that the appellant failed to show any federal-law error in the finding that no appealable prosecution order existed. The request for free legal aid was refused because the appeal had no prospects of success. Court costs of CHF 500 were charged to the appellant, taking account of his financial situation.

Omnilex headnote

Art. 108 BGG; admissibility of a complaint challenging a cantonal non-entry decision where no appealable prosecution order exists; the appellant must specifically demonstrate a violation of federal law or arbitrariness in the cantonal reasoning. Mere disagreement with the refusal to entertain a cantonal remedy is insufficient. Legal aid under Art. 64 BGG is refused where the appeal is manifestly devoid of prospects of success; in fixing costs under Art. 65 para. 2 and Art. 66 para. 1 BGG, the court may take account of the party's financial situation.

Urteil vom 11. November 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
Beschwerdegegnerin.

Gegenstand
Vollzug,

Extracted by Omnilex

Key legal question

Whether the appeal against the cantonal non-entry decision was admissible.

Extracted holding

The complaint did not show any arbitrariness or other federal-law violation in the cantonal court's refusal to enter into the matter; the Federal Court therefore did not enter on the appeal.

Extracted reasoning

The lower court relied on the Swiss Criminal Procedure Code because no appealable decision of the prosecution existed; the appellant did not demonstrate why this was wrong.

Key legal question

Whether the appellant was entitled to free legal aid before the Federal Court.

Extracted holding

Legal aid was denied because the requested relief was hopeless.

Extracted reasoning

The claims lacked prospects of success, so the requirements of Art. 64 BGG were not met.

Key legal question

Who bears the Federal Court costs and in what amount.

Extracted holding

The appellant must pay court costs of CHF 500, with his poor financial situation taken into account in the amount.

Extracted reasoning

As the appeal was not entered into, costs were imposed on the appellant under Art. 66 para. 1 BGG, and the fee was moderated under Art. 65 para. 2 BGG.
