Omnilex summary

The Federal Supreme Court dealt with a criminal-law appeal against a judgment of the Aargau cantonal court concerning SVG violations. After ordering the appellant to submit the missing challenged decision within a set deadline under Art. 42(5) BGG, the court received no further response. It therefore declined to enter on the appeal under Art. 108 BGG. In view of the circumstances, the court exceptionally waived court costs.

Omnilex headnote

Art. 42 Abs. 5 BGG; Art. 108 BGG; non-entry owing to failure to cure a formal defect in the appeal submission. Where the appellant is ordered to remedy a deficiency by filing the missing challenged decision and is expressly warned of the consequence of non-compliance, failure to act within the set time limit justifies non-entry in summary procedure. If circumstances warrant, the Federal Court may exceptionally waive the imposition of costs.

Key legal question

Whether the appeal could be entered into despite the missing appealed decision after a deadline under Art. 42(5) BGG.

Extracted holding

No. Because the appellant did not comply with the order to file the missing challenged decision by the deadline, the appeal was not admitted for consideration.

Extracted reasoning

The appellant was warned that failure to cure the defect would lead to the submission being disregarded. He did not respond, so the court applied Art. 108 BGG and declined to enter on the appeal.

Key legal question

Whether court costs should be imposed despite non-entry.

Extracted holding

No costs were levied exceptionally.

Extracted reasoning

The court expressly departed from the usual rule and waived the assessment of costs.
