Omnilex summary

The Federal Supreme Court did not enter into the appellant's criminal complaint because he failed to engage with the cantonal court's reasons and thus did not satisfy the federal reasoning requirements. The request for free legal aid was rejected as the complaint was hopeless. Court costs of CHF 500 were charged to the appellant, reduced in light of his financial situation.

Omnilex headnote

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; admissibility of a federal complaint: the appellant must specifically address the reasoning of the challenged decision and show, with regard to each decisive consideration, why it is unlawful. A mere repetition of one's own version of the facts or a general assertion that the lower court erred is insufficient. If this requirement is not met, the complaint is not entered into under Art. 108 BGG. A request for free legal aid under Art. 64 BGG is to be denied where the legal remedies sought are hopeless; the court may take the party's financial situation into account by reducing the court fee under Art. 65 Abs. 2 BGG. Costs follow the outcome under Art. 66 Abs. 1 BGG.

Urteil vom 7. Oktober 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, 8090 Zürich,
Beschwerdegegnerin.

Gegenstand
Gewalt und Drohung gegen Behörden und Beamte etc.,

Beschwerde gegen den Entscheid des Obergerichts des Kantons Zürich, I. Strafkammer, vom 26. Juni 2009 (Zirkulations-Beschluss SB090276/U/eh).
Der Einzelrichter zieht in Erwägung:

1.
