Omnilex summary

X.________ challenged the cantonal court's decision declaring inadmissible her appeal against the prosecutor's classing of her complaint against A.________. The Federal Supreme Court held that her filing did not meet the statutory motivation requirements because it did not explain why the cantonal court's reasoning was wrong. The appeal was therefore inadmissible. Exceptionally, no court fees were charged.

Omnilex headnote

Art. 42 al. 1 and 2 LTF; art. 108 al. 1 let. b LTF: requirements of motivation of a federal appeal. The appellant must set out, in a succinct but reasoned manner, in what respect the challenged decision violates federal law. Mere factual criticism or assertions unrelated to the reasoning of the cantonal authority do not suffice. Where the submission fails to engage with the grounds of the appealed decision, the appeal is inadmissible under the summary procedure of art. 108 al. 1 let. b LTF. Exceptionally, the Federal Supreme Court may dispense with court costs under art. 66 al. 1 LTF.

Arrêt du 22 septembre 2009
Cour de droit pénal

Composition
M. le Juge Favre, Président.
Greffière: Mme Gehring.

Parties
X.________,
recourante,

contre

Ministère public du canton de Neuchâtel, 2001 Neuchâtel 1,
intimé.

Objet

Favre Gehring

Key legal question

Whether the criminal appeal met the Federal Supreme Court's motivation requirements.

Extracted holding

No. The appellant did not explain why the cantonal court's reasoning or the inadmissibility ruling violated federal law.

Extracted reasoning

Under Art. 42(1) and (2) LTF, a recourse must briefly show how the challenged decision breaches the law; merely disputing unrelated facts is insufficient. Because the submission did not address the cantonal court's reasoning, it failed the admissibility requirements and had to be dismissed under Art. 108(1)(b) LTF.

Key legal question

Whether court fees should be charged.

Extracted holding

No court fees were imposed exceptionally.

Extracted reasoning

The court ordered the decision without costs under Art. 66(1) LTF.
