Omnilex summary

The Federal Supreme Court did not enter into the complaint against the summons to serve a five-day substitute custodial sentence because the filing did not address the cantonal court's reasoning and therefore failed to satisfy the Federal Supreme Court's reasoning requirements. The appellant only stated that he would be able to pay the fine at the beginning of 2012. Court costs of CHF 800 were imposed on him.

Omnilex headnote

Art. 108 BGG; requirements of reasoning for complaints to the Federal Supreme Court: a submission must engage with the challenged decision and explain, with reference to Art. 95 BGG, in what respect federal law is violated. Mere assertions or factual statements, without addressing the decisive reasoning of the lower court, are insufficient and lead to non-entry. When the complaint is not entered into, court costs are generally charged to the unsuccessful party pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 20. September 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiberin Arquint Hill.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Amt für Justizvollzug des Kantons Zürich,
Amtsleitung, Feldstrasse 42, 8090 Zürich,
Beschwerdegegner.

Gegenstand
Vorladung in den Strafvollzug,

Beschwerde gegen das Urteil des Verwaltungsgerichts des Kantons Zürich, 3. Abteilung, vom 24. August 2011.

Der Einzelrichter zieht in Erwägung:

1.

Abteilung, schriftlich mitgeteilt.

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the complaint was not entered into, the costs followed the outcome.
