Omnilex summary

The Federal Court considered a criminal complaint against a cantonal decision on revocation of a suspended sentence. After the appellant failed to pay the required CHF 2,000 advance, he requested to pay the remaining CHF 1,500 in instalments because of temporary liquidity problems. The court found the instalment request insufficiently reasoned and therefore did not enter into it. Since the advance was not paid in full within the non-extendable grace period, the court likewise did not enter into the complaint under the warning previously given. Court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 62 Abs. 3 und Art. 109 BGG; non-payment of the advance on costs and inadmissibility of an instalment request. A request for deferment or instalment payment of the advance costs must be sufficiently substantiated; absent a cogent showing of entitlement, the Federal Court will not enter into the request. If the advance is not paid within the non-extendable grace period set under Art. 62 Abs. 3 BGG, the appeal is not entered into pursuant to Art. 109 BGG. Costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 29. November 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Bundesrichter Wiprächtiger, Zünd,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer, vertreten durch Rechtsanwalt Willi Berchten,

gegen

Staatsanwaltschaft des Kantons Glarus, Burgstrasse 16, 8750 Glarus,
Beschwerdegegnerin.

Gegenstand

August 2007.

Das Bundesgericht zieht in Erwägung:
1.
Der Beschwerdeführer wurde mit Verfügung vom 4. Oktober 2007 aufgefordert, spätestens am 25. Oktober 2007 einen Kostenvorschuss von Fr. 2'000.-- einzuzahlen (act. 3).

Extracted by Omnilex

Key legal question

Whether the request to pay the advance costs in instalments should be granted

Extracted holding

The request was inadmissible because it was insufficiently reasoned; no basis existed to grant instalments.

Extracted reasoning

The submission gave no reason showing why the Federal Court could allow payment by installments.

Key legal question

Whether the complaint could be entered into despite non-payment of the advance within the extended deadline

Extracted holding

No. Because the advance was not paid within the non-extendable grace period, the court did not enter into the complaint.

Extracted reasoning

The appellant paid only CHF 500 and failed to satisfy the remaining advance despite a warning that non-payment would lead to non-entry under Art. 109 BGG.

Key legal question

How the court costs should be allocated

Extracted holding

The court costs were imposed on the appellant.

Extracted reasoning

As the unsuccessful party, the appellant had to bear the costs under Art. 66(1) BGG.
