Omnilex summary

The Federal Supreme Court held that the complaint against the district court's non-entry decision was inadmissible because the appellant failed to engage with the cantonal formal requirements and thus did not meet the federal reasoning requirements. Since the lower court had not addressed the merits, the Federal Supreme Court also refrained from reviewing the substance. The appellant was ordered to pay court costs of CHF 500.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; inadmissibility of an appeal for insufficient reasoning against a non-entry decision based on cantonal formal requirements. Where the appellant does not confront the decisive cantonal procedural requirements, the federal complaint fails to satisfy the substantiation duty. If the authority below did not examine the merits, the Federal Supreme Court likewise cannot enter into a substantive review. Costs are charged to the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 5. September 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________, Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich, Beschwerdegegnerin.

Gegenstand
Bussenverfügung,

Beschwerde gegen die Verfügung des
Bezirksgerichts Affoltern, Einzelrichter
in Strafsachen, vom 16. Juni 2008.

Der Präsident zieht in Erwägung:

1.

Lausanne, 5. September 2008

Key legal question

Whether the federal appeal was sufficiently reasoned to challenge the district court's non-entry decision.

Extracted holding

No. The appellant did not address the cantonal formal requirements, so the appeal did not satisfy the federal reasoning requirements.

Extracted reasoning

Because the lower court did not examine the merits, the Federal Supreme Court could not do so either; under the appeal's deficient reasoning, non-entry was required under the summary procedure.

Key legal question

Who bears the court costs of the federal proceedings?

Extracted holding

The appellant must bear the costs.

Extracted reasoning

Costs follow the result and are imposed on the unsuccessful appellant.
