Omnilex summary

The Federal Supreme Court held that the appellant’s filing did not properly challenge the only reviewable point, namely the absence of any asserted ground for restoration of the deadline. Because he argued the merits instead of addressing the non-entry reasoning, the complaint was not admissible under the Federal Supreme Court Act. The Court therefore refused to enter into the case, denied free legal aid because the appeal was hopeless, and ordered the appellant to pay reduced court costs of CHF 500. No compensation was awarded to the respondent.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; admissibility of a complaint against a decision refusing to enter into a restoration request: the appellant must specifically address the reasoning of the challenged decision and may not merely present the merits of the underlying dispute. If the appeal does not engage with the decisive issue, it is not entered into. A request for free legal aid is to be refused where the appeal lacks prospects of success (Art. 64 BGG). Court costs are borne by the unsuccessful party, with due regard to financial circumstances (Art. 66 Abs. 1 and Art. 65 Abs. 2 BGG).

Urteil vom 29. Juni 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

A.________,
vertreten durch Rechtsanwalt Urs Bertschinger,
Beschwerdegegner.

Gegenstand
Wiederherstellung (einfache Körperverletzung),

Beschwerde gegen den Entscheid des Kantonsgerichts St. Gallen, Strafkammer, vom 11. Mai 2009.

Der Präsident zieht in Erwägung:

1.

Extracted by Omnilex

Key legal question

Whether the complaint sufficiently addressed the only issue open on appeal, namely the unasserted ground for restoration of the deadline.

Extracted holding

The complaint did not engage with the relevant restoration-ground question and instead argued the merits, so it could not be reviewed.

Extracted reasoning

Under Art. 42(2) and Art. 106(2) BGG, the appellant had to specifically challenge the reason given for the non-entry decision; since he failed to do so, the complaint was inadmissible and no merits review was possible.

Key legal question

Whether the request for free legal aid should be granted.

Extracted holding

Free legal aid was refused because the appeal had no prospects of success.

Extracted reasoning

The requests were manifestly hopeless, which precluded legal aid under Art. 64 BGG.

Key legal question

Allocation of court costs and compensation.

Extracted holding

Court costs were imposed on the appellant, reduced in light of his financial situation; no compensation was awarded to the respondent.

Extracted reasoning

Costs follow the losing party under Art. 66(1) BGG, and the respondent incurred no reimbursable expenses before the Federal Supreme Court.
