Omnilex summary

X. appealed to the Federal Supreme Court against a cantonal appellate judgment convicting him of attempted sexual coercion and sexual harassment and sentencing him to 324 hours of community service and a CHF 100 fine. He argued that he had not been confronted with the complainant and had no chance to question her. The Federal Supreme Court held that the lower court had already dealt with these objections, found no violation of the ECHR, and dismissed the appeal in written proceedings. It also rejected the request for legal aid and imposed reduced court costs of CHF 800.

Omnilex headnote

Art. 109 BGG; confrontation rights and right to question witnesses in criminal proceedings; where the cantonal appellate court has already addressed the complaint concerning the absence of confrontation with a witness and the inability to put questions, the Federal Supreme Court may refer to those reasons and dismiss the appeal summarily if no ECHR violation is shown. Legal aid under Art. 64 BGG is unavailable where the appeal lacks prospects of success; court costs are allocated under Art. 66 Abs. 1 BGG, with regard to the party's financial situation under Art. 65 Abs. 2 BGG.

Urteil vom 29. Juni 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Bundesrichter Wiprächtiger, Mathys,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand
Versuchte sexuelle Nötigung, sexuelle Belästigung,

Beschwerde gegen das Urteil des Obergerichts des Kantons Aargau, Strafgericht, 2. Kammer, vom 15. April 2009.

Das Bundesgericht zieht in Erwägung:

1.

3.
Das Gesuch um unentgeltliche Verbeiständung wird abgewiesen.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Strafgericht, 2. Kammer, schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the absence of confrontation with the key witness and the inability to question her violated the accused's rights under the ECHR.

Extracted holding

No violation was established; the Federal Supreme Court referred to the cantonal court's reasoning and found the complaint unfounded.

Extracted reasoning

The lower court had already addressed the confrontation and questioning rights. The Federal Supreme Court saw no reason to add anything and found no ECHR violation.

Key legal question

Whether the conviction for attempted sexual coercion and sexual harassment should be overturned and an acquittal entered.

Extracted holding

The appeal seeking acquittal was rejected; the conviction remained in force.

Extracted reasoning

Because the procedural complaint failed, there was no basis to disturb the judgment of conviction.

Key legal question

Whether legal aid and free legal representation should be granted.

Extracted holding

No, because the appeal had no prospects of success.

Extracted reasoning

The requests were rejected as the legal remedies were hopeless.
