Omnilex summary

The detained appellant asked the Zurich authorities to stop the review of his confinement measure. The cantonal court rejected that request, and he brought the matter to the Federal Supreme Court. The court held that he had not shown any irreparable disadvantage caused by the mere review of the detention measure, so the complaint was not admissible and could be dealt with under Art. 108 BGG. It also refused free legal aid because the appeal had no prospects of success. Reduced court costs of CHF 500 were imposed on the appellant.

Omnilex headnote

Art. 93 Abs. 1 lit. b BGG; Art. 108 BGG: A complaint is inadmissible against an interlocutory cantonal decision refusing to discontinue the review of a detention measure where the appellant fails to demonstrate an irreparable legal disadvantage. Mere review of a deprivation-of-liberty measure does not, without more, establish such harm. Where the underlying legal request is hopeless, free legal aid must be refused under Art. 64 BGG. Court costs may be imposed on the unsuccessful appellant under Art. 66 Abs. 1 BGG, with reduction under Art. 65 Abs. 2 BGG if financial circumstances so require.

Urteil vom 18. Juli 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________, Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich, Beschwerdegegnerin.

Gegenstand
Verwahrungsüberprüfung,

Beschwerde gegen das Urteil des Obergerichts des Kantons Zürich, III. Strafkammer, vom 10. Juni 2008.

Der Präsident zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.
