Omnilex summary

X. filed a criminal complaint against Y. and Z. The cantonal complaint judge declared his complaint against the refusal to proceed inadmissible for insufficient motivation. Before the Federal Supreme Court, X. argued only the merits and did not challenge the non-entry reasoning. The Court therefore held the appeal insufficiently reasoned and declared it inadmissible, while taxing court costs of CHF 800 against X.

Omnilex headnote

Art. 42 al. 1 et 2 LTF; Art. 108 al. 1 let. b LTF; inadmissibility of a federal appeal for lack of reasoning. The appeal must specifically and concisely show in what respect the challenged decision violates federal law. It is not enough to discuss the merits if the cantonal decision rests on a non-entry ground that is not addressed. Where the appellant fails to contest the reasoning supporting the refusal to enter into the cantonal complaint, the Federal Supreme Court will not examine the merits and will dismiss the appeal in summary procedure (consid. 1).

Arrêt du 31 mai 2010
Cour de droit pénal

Composition
M. le Juge Favre, Président.
Greffier: M. Oulevey.

Participants à la procédure
X.________,
recourant,

contre

Ministère public du canton du Valais, case postale 2282, 1950 Sion 2,
intimé.

Objet

Faits:

A.
X.________ a porté plainte pénale (art.

Key legal question

Whether the federal appeal was sufficiently reasoned under Art. 42 LTF so that the Court could review the cantonal non-entry decision.

Extracted holding

No. The appellant only argued the merits and did not address the cantonal finding that his complaint was inadmissible for lack of reasoning.

Extracted reasoning

Under Art. 42(1)-(2) LTF, the appeal must explain concisely how the challenged decision violates law. Because the appellant failed to attack the non-entry rationale, the appeal was insufficiently reasoned and had to be dismissed under Art. 108(1)(b) LTF.
