Extracted by Omnilex

Omnilex summary

The Federal Supreme Court declared the criminal complaint inadmissible because the appellant did not sufficiently challenge the finding that he lacked procedural capacity. Arguments on other matters were not considered. The request for suspensive effect became moot. Court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; admissibility of a complaint that does not substantively address the decisive finding of lack of procedural capacity. Where the appellant fails to set out, in a reasoned manner, why the cantonal court erred on the determinative issue, the Federal Supreme Court does not enter into the complaint. Submissions concerning other questions are irrelevant if they do not relate to the dispositive ground. If the main appeal is not entered into, a request for suspensive effect becomes moot; court costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 19. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,

gegen

Staatsanwaltschaft des Kantons Schwyz, Archivgasse 1, 6430 Schwyz.

Gegenstand

3.
Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft des Kantons Schwyz und dem Kantonsgericht des Kantons Schwyz, 2. Rekurskammer, schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the complaint was admissible despite the appellant's failure to substantiate his challenge to the finding that he lacked procedural capacity.

Extracted holding

The challenge to procedural capacity was insufficiently reasoned; to the extent the complaint addressed other matters, it could not be examined.

Extracted reasoning

The submission did not meet the reasoning requirements of Art. 42(2) and Art. 106(2) BGG. Because the appeal was not properly reasoned on the decisive issue, the court could not enter into it.

Key legal question

Whether the request for suspensive effect remained pending.

Extracted holding

The request became moot after the non-entry decision.

Extracted reasoning

Once the court decided not to enter into the complaint, there was no longer any need to decide on interim suspensive effect.

Key legal question

Who bears the court costs of the Federal Supreme Court proceedings.

Extracted holding

The appellant must pay the court costs.

Extracted reasoning

Costs were imposed on the unsuccessful appellant under Art. 66(1) BGG.
