Omnilex summary

X.________ challenged a summons to serve 19 days' detention arising from two fine-conversion decisions. The Zurich Directorate had already rejected her cantonal appeal. Before the Federal Supreme Court she again attacked the substantive correctness of the underlying penalty decisions, without engaging with the cantonal reasoning. The President of the Criminal Division held that the complaint could not be heard under Art. 108 BGG. He denied free legal aid because the appeal was hopeless and ordered reduced court costs of CHF 500 against the complainant.

Omnilex headnote

Art. 108 BGG; admissibility of a federal complaint that does not address the decisive cantonal reasoning. A complaint is inadmissible where the appellant merely repeats objections to the merits of earlier penalty or conversion decisions without confronting the grounds of the challenged decision. In summary proceedings, the President may refuse entry if the submission manifestly fails to meet the requirements of reasoned challenge. Free legal aid under Art. 64 BGG is excluded where the legal remedies are hopeless; costs may be moderated under Art. 65 Abs. 2 BGG in light of the party’s financial circumstances, while still being imposed under Art. 66 Abs. 1 BGG on the losing party.

Urteil vom 4. Juli 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführerin,

gegen

Amt für Justizvollzug des Kantons Zürich, Amtsleitung, Feldstrasse 42, 8090 Zurich,
Beschwerdegegner.

Gegenstand

Lausanne, 4. Juli 2008
Im Namen der Strafrechtlichen Abteilung
des Schweizerischen Bundesgerichts

Extracted by Omnilex

Key legal question

Whether the federal complaint challenging the substantive correctness of the underlying penalty and fine-conversion decisions was admissible.

Extracted holding

The complaint was not admissible because the appellant did not engage with the cantonal reasoning and sought review of matters that could no longer be heard.

Extracted reasoning

The submissions did not address the decisive cantonal grounds; under Art. 108 BGG the president could not enter into the merits.

Key legal question

Whether free legal aid should be granted.

Extracted holding

Free legal aid was refused because the appeal had no prospects of success.

Extracted reasoning

As the complaint was inadmissible and thus hopeless, the statutory condition of non-frivolousness was lacking.

Key legal question

Allocation of court costs.

Extracted holding

Court costs were imposed on the complainant, reduced in view of her financial situation.

Extracted reasoning

Costs follow the outcome, and the fee was moderated because of the appellant's financial circumstances.
