Omnilex summary

The Federal Supreme Court dealt with a criminal appeal against the denial of a reopening request in an arson/attempted fraud case. It held that the appellant's later submissions did not engage with the reasoning of the cantonal decision, especially E. 4c, and thus did not satisfy the Federal Supreme Court's pleading requirements. Requests unrelated to the reopening proceedings were also inadmissible. The Court therefore declined to enter into the appeal in summary procedure and ordered the appellant to pay CHF 800 in court costs.

Key legal question

Whether the criminal appeal met the Federal Supreme Court's reasoning requirements

Extracted holding

No; the submissions did not engage with the reasons of the challenged decision and therefore failed to satisfy the statutory pleading requirements.

Extracted reasoning

The appellant's filings did not address the reasoning of the Obergericht, in particular its reasoning at E. 4c. They therefore did not comply with Art. 42(2) and Art. 106(2) BGG.

Key legal question

Whether the appeal should be entered into under the simplified procedure

Extracted holding

No; because the appeal was insufficiently reasoned and unrelated requests were inadmissible, the Court would not enter into the matter under Art. 108 BGG.

Extracted reasoning

A manifestly insufficient appeal may be disposed of in the summary procedure without entering into the merits.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the appellant failed, he had to bear the costs of the proceedings.
