Omnilex summary

The Federal Supreme Court held that the appellant lacked standing to challenge the refusal to open criminal proceedings against an official guardian for abuse of office. He was neither a private prosecutor nor sufficiently shown to be a victim with direct impact on civil claims. The court also noted that the appellant’s father, not being a lawyer, could not represent him before the court, but waived a cure period for efficiency reasons. Legal aid was refused as the appeal was hopeless, and the appellant was ordered to pay a reduced court fee of CHF 500.

Omnilex headnote

Art. 81 Abs. 1 BGG, Art. 108 BGG; standing to challenge a decision refusing to open criminal proceedings. A complainant is entitled to lodge a criminal-law appeal only if he has participated in the cantonal proceedings or is otherwise specifically entitled by law and demonstrates a legally protected interest. Where the complainant is neither private prosecutor nor victim within the meaning of the Victim Assistance Act, standing is absent unless direct effects on civil claims are shown. General criticism of official conduct does not suffice to establish victim status. Non-lawyer representation before the Federal Supreme Court in criminal matters is impermissible under Art. 40 Abs. 1 BGG; a cure period under Art. 42 Abs. 5 BGG may be dispensed with for reasons of procedural economy. Legal aid under Art. 64 BGG is excluded for manifestly hopeless appeals.

Urteil vom 9. August 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Wiprächtiger, präsidierendes Mitglied,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer, vertreten durch Y.________,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Spisergasse 15, 9001 St. Gallen.

Gegenstand

Juli 2007.

Das präsidierende Mitglied zieht in Erwägung:
1.

Key legal question

Whether the appellant had standing to complain about the non-opening of criminal proceedings for abuse of office.

Extracted holding

He lacked standing under Art. 81 BGG because he was neither a private prosecutor nor sufficiently shown to be directly affected as a victim, and any impact on civil claims was not apparent.

Extracted reasoning

The prosecuting authority had participated in the cantonal proceedings; the appellant did not show an immediate impairment of his psychic integrity, and his general criticism of the conduct of relatives and authorities did not establish victim status or an effect on civil claims.

Key legal question

Whether the appellant could be represented before the Federal Supreme Court by his father, who is not a lawyer.

Extracted holding

No; a non-lawyer father may not represent him in criminal matters before the Federal Supreme Court.

Extracted reasoning

Art. 40 Abs. 1 BGG requires qualified representation; the court noted that a deadline to cure the defect under Art. 42 Abs. 5 BGG would normally be set, but waived this for reasons of procedural economy.

Key legal question

Whether legal aid should be granted.

Extracted holding

No; the request was rejected because the appeal had no prospect of success.

Extracted reasoning

Under Art. 64 BGG, legal aid is unavailable where the claims are manifestly hopeless.
