Omnilex summary

X. challenged a Vaud dismissal order that had cleared Y. and sent four other accused persons, including X., to trial for negligent grievous bodily harm after a workplace accident. The Tribunal fédéral held that X. had no legal interest allowing him to seek prosecution of Y. or the organs of Z. SA, since criminal prosecution belongs to the public prosecutor and a factual interest is insufficient. The appeal was therefore declared inadmissible, and CHF 800 in costs were imposed on X.

Omnilex headnote

Art. 81 al. 1 let. b LTF; standing to appeal against a dismissal order in criminal matters. A private party has no legally protected interest in the prosecution or punishment of another person; the criminal action belongs to the public prosecutor, subject only to statutory exceptions, in particular those expressly provided by the LAVI. A merely factual interest does not suffice to confer standing. In the absence of such standing, the appeal is inadmissible under Art. 108 al. 1 let. a LTF (consid. 1).

Faits:

A.

Extracted by Omnilex

Key legal question

Whether X. had standing to appeal to the Federal Supreme Court against the dismissal order in favor of Y. and the refusal to indict other persons.

Extracted holding

X. lacked a legal interest protected by criminal law proceedings and therefore had no standing to seek review of the favorable dismissal order.

Extracted reasoning

A private person has no right to the prosecution or punishment of others; criminal enforcement belongs to the public prosecutor, subject only to statutory exceptions. A mere factual interest is insufficient under Art. 81(1)(b) LTF.

Key legal question

Costs of the federal proceedings.

Extracted holding

The appellant must bear the court costs, reduced to CHF 800 because the matter was decided by a single judge.

Extracted reasoning

The losing party bears the costs.
