Omnilex summary

The Federal Court dismissed the inmate's complaint against the Zurich justice enforcement authority and the cantonal administrative court's refusal to order a transfer from the security unit to the normal prison regime. It held that the complaint did not demonstrate any violation of federal law and could be decided in summary form under Art. 109 BGG. Any requests beyond the transfer request were not entered into. Court costs of CHF 800 were imposed on the appellant, taking his financial situation into account.

Omnilex headnote

Art. 109 Abs. 3 BGG, Art. 42 Abs. 2 BGG, Art. 106 Abs. 2 BGG; complaint against continued placement in a security unit and scope of review. Where the appellant does not substantiate, with reference to the challenged reasoning, how the cantonal decision violates federal law, the Federal Court may rely on the lower court's reasoning and dismiss the complaint in summary procedure. Requests not properly connected to the object of the dispute are not examined. Court costs are borne by the unsuccessful party, with due regard to financial circumstances under Art. 65 Abs. 2 BGG and Art. 66 Abs. 1 BGG.

Urteil vom 3. Februar 2012
Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Bundesrichterin Jacquemoud-Rossari,
Bundesrichter Schöbi,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Amt für Justizvollzug des Kantons Zürich, Amtsleitung, Feldstrasse 42, 8090 Zürich,
Beschwerdegegner.

Gegenstand
Verbleib in Sicherheitsabteilung,

Beschwerde gegen das Urteil des Verwaltungsgerichts des Kantons Zürich, 3. Abteilung, Einzelrichter, vom 14. Dezember 2011.

Das Bundesgericht zieht in Erwägung:

1.

Abteilung, Einzelrichter, schriftlich mitgeteilt.
