Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint against a Zurich magistrate-related matter. It held that the complainant, as a mere reporting person, had not demonstrated standing under Art. 81 BGG and that the filing was also insufficiently reasoned and otherwise inadmissible. The request for free legal aid was refused because the complaint was hopeless. The complainant was ordered to pay court costs of CHF 800; no reduction was granted despite the abusive manner of the proceedings.

Omnilex headnote

Art. 81 BGG, Art. 42 Abs. 2 BGG, Art. 106 Abs. 2 BGG, Art. 41 Abs. 7 BGG, Art. 108 BGG; standing and admissibility of a criminal complaint by a mere reporting person. A complainant who does not show a legally protected interest within the meaning of Art. 81 BGG lacks standing. If the submission does not meet the increased reasoning requirements of Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG, or is otherwise inadmissible under Art. 41 Abs. 7 BGG, the Court may decline to enter into the matter in summary procedure under Art. 108 BGG. Free legal aid is refused where the request is manifestly hopeless (Art. 64 Abs. 1 BGG). Abusive litigation conduct may preclude any reduction of the court fee (Art. 65 Abs. 2 BGG).

Urteil vom 24. Juli 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand
