Omnilex summary

The Federal Supreme Court held that the complaint against the cantonal non-entry decision was inadmissible because the appellant did not address the decisive reason for that decision, namely the non-payment of the requested cost advance after refusal of legal aid. The court therefore did not examine the merits. Federal court costs of CHF 500 were charged to the appellant, with due regard to his financial circumstances.

Omnilex headnote

Art. 108 BGG; a federal complaint is inadmissible where the appellant does not engage with the decisive reasoning of the challenged decision. The duty to substantiate requires that the submissions address the specific ground on which the lower authority refused to enter into the matter; a mere general attack is insufficient (consid. 1). Where the complaint is not entered into, costs are borne by the appellant under Art. 66 Abs. 1 BGG, with the fee to be moderated according to financial circumstances under Art. 65 Abs. 2 BGG (consid. 2).

Beschwerdegegnerin.

Gegenstand
SVG-Delikte,

Beschwerde gegen den Präsidialbescheid des Kantonsgerichts Appenzell I.Rh., Abteilung Zivil- und Strafgericht, vom 17. März 2009.

Der Präsident zieht in Erwägung:

1.

Key legal question

Whether the federal complaint was admissible despite the appellant not challenging the failure to pay the required cost advance.

Extracted holding

The complaint cannot be examined because the appellant does not engage with the decisive ground of the cantonal non-entry decision.

Extracted reasoning

Under Art. 108 BGG, submissions that do not address the reasoning of the challenged decision are not entered into. The federal filing said nothing about the non-payment of the requested advance.

Key legal question

Allocation of federal court costs

Extracted holding

Court costs are imposed on the appellant, reduced in light of his financial situation.

Extracted reasoning

As the complaint was inadmissible, costs follow the outcome; the appellant's financial circumstances were taken into account when fixing the fee.
