Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint because the appellant failed to pay the required court advance of CHF 2,000 even after being granted a statutory grace period. The advance-payment order was served, but the amount remained unpaid. The Court therefore issued a non-entry decision under Art. 108 BGG and imposed court costs of CHF 800 on the appellant.

Omnilex headnote

Art. 108 BGG; non-payment of the court advance and non-entry into the appeal; if the appellant does not pay the ordered advance within the original time limit and the additional grace period, the Federal Supreme Court may decide without further proceedings not to enter into the appeal. Proper service of the payment order and warning is sufficient; absent timely payment, the remedy is inadmissible. Court costs are borne by the appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 1. März 2012
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Luzern, Zentralstrasse 28, 6002 Luzern,
Beschwerdegegnerin.

Gegenstand
Aufhebung der Rechtskraft und Wiederherstellung der Einsprachemöglichkeit,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Luzern, 2. Abteilung, vom 10. November 2011 (2N 11 82).
Der Einzelrichter zieht in Erwägung:

1.

Abteilung, schriftlich mitgeteilt.

Key legal question

Whether the appeal had to be entered into despite non-payment of the court advance.

Extracted holding

No. Because the appellant did not pay the ordered advance within the original deadline or the statutory grace period, the Court could not enter into the appeal.

Extracted reasoning

The advance-payment order and subsequent grace-period order were duly served; the amount remained unpaid, so non-entry followed under Art. 108 BGG.

Key legal question

Allocation of court costs

Extracted holding

The court costs were charged to the appellant.

Extracted reasoning

As the appeal was not entered into, the costs were imposed on the appellant under the Federal Supreme Court Act.
