Omnilex summary

The Federal Supreme Court held that the appellant lacked standing to challenge the St. Gallen authorities' refusal to open criminal proceedings because the complaint concerned time-barred offenses and no legally protected interest existed. It also considered the filing querulous due to abusive language. The appeal was not entered into, and court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 81 Abs. 1 lit. b BGG; Art. 42 Abs. 7 BGG; Art. 108 BGG; standing to appeal and querulous pleadings in criminal matters. A complainant is entitled to challenge a refusal to open criminal proceedings only if he can demonstrate a legally protected interest in the annulment or modification of the decision. No such interest exists where the alleged offenses are time-barred, since the authorities are not required to investigate them. A pleading that contains abusive, vexatious, or grossly insulting language may be treated as querulous litigation and, in clear cases, be rejected without substantive examination in the summary procedure under Art. 108 BGG.

Urteil vom 2. Juli 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Spisergasse 15, 9001 St. Gallen.

Gegenstand
