Omnilex summary

X.________ challenged the Fribourg cantonal criminal chamber’s confirmation of the refusal to open criminal proceedings against Dr. Y.________. The Federal Supreme Court held that the appeal did not engage with the decisive reasoning that the alleged conduct could at most amount to offences against honour, which were subject to a private complaint filed too late. The filing was therefore inadmissible for insufficient motivation. Legal aid was denied because the appeal lacked prospects of success, and reduced court costs of CHF 500 were charged to the appellant.

Omnilex headnote

Art. 42 al. 1 et 2 LTF; Art. 108 al. 1 let. b LTF; an appeal must address the decisive reasons of the challenged decision and succinctly show a violation of federal law. If the appellant merely argues the merits without confronting the reasoning on which the lower court based its ruling, the submission is insufficiently reasoned and inadmissible. Where the appeal is manifestly devoid of prospects, legal aid must be refused under Art. 64 al. 1 LTF a contrario; costs are imposed on the unsuccessful appellant under Art. 66 al. 1 LTF, with possible reduction according to financial circumstances.

Arrêt du 7 mai 2010
Cour de droit pénal

Composition
M. le Juge Favre, Président.
Greffier: M. Oulevey.

Participants à la procédure
X.________,
recourant,

contre

Ministère public de l'État de Fribourg, case postale, 1700 Fribourg,
intimé.

Objet

Faits:

A.

Extracted by Omnilex

Key legal question

Whether the complaint to the Federal Supreme Court was sufficiently reasoned under Art. 42 LTF.

Extracted holding

The appeal did not address the decisive reasoning of the cantonal judgment and therefore failed to show any violation of law.

Extracted reasoning

Under Art. 42(1)-(2) LTF, the appellant must explain briefly why the challenged decision breaches the law. Because he did not contest the finding that the alleged acts, at most, concerned offences against honour subject to a private complaint that was filed late, the appeal was inadequately motivated.

Key legal question

Whether legal aid should be granted.

Extracted holding

Legal aid was refused because the appeal had no prospect of success.

Extracted reasoning

Since the claims were manifestly without chance of success, the statutory condition for legal aid was not met.

Key legal question

Who bears the judicial costs and in what amount.

Extracted holding

The appellant must pay reduced court costs of CHF 500.

Extracted reasoning

Costs are imposed on the unsuccessful appellant; the amount was reduced to reflect his financial situation.
