Omnilex summary

The Federal Supreme Court held that the 42-page, 25-motion criminal appeal against a CHF 600 traffic fine was querulous and therefore inadmissible. It did not enter into the matter under Art. 108 BGG. The appellant’s request for free legal aid was refused because the appeal was manifestly hopeless. Court costs of CHF 1,000 were imposed on the appellant, with the litigating style taken into account in fixing the fee.

Omnilex headnote

Art. 42 Abs. 7 BGG; Art. 108 BGG: querulous or abusive submissions are inadmissible and may be disposed of summarily without merits review. Art. 64 BGG: legal aid is to be refused where the appeal is manifestly devoid of prospects of success. Art. 66 Abs. 1 BGG in conjunction with Art. 65 Abs. 2 BGG: court costs are borne by the unsuccessful party; the fee may be increased or otherwise adjusted in view of a querulous manner of litigation.

Urteil vom 19. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand
Verletzung von Verkehrsregeln,

Beschwerde in Strafsachen gegen das Urteil des Obergerichts des Kantons Zürich, I. Strafkammer, vom 15. März 2007.

Das Präsidium zieht in Erwägung:
1.

Key legal question

Whether the criminal appeal was admissible despite its querulous and abusive character

Extracted holding

The appeal was inadmissible and no merits review was entered into.

Extracted reasoning

The filing contained 25 requests and 42 pages and was classified as querulous; under Art. 42(7) BGG it was therefore inadmissible and could be disposed of under Art. 108 BGG.

Key legal question

Whether the appellant was entitled to free legal aid

Extracted holding

The request for free legal aid was denied because the appeal was hopeless from the outset.

Extracted reasoning

Since the legal claims had no prospect of success, the requirements of Art. 64 BGG were not met.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant and set at CHF 1,000.

Extracted reasoning

Costs were charged to the losing appellant; the querulous manner of litigation was considered in fixing the fee.
