Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint against the Zurich High Court’s decision on discontinuance of an investigation. The appellant failed to file the challenged decision despite being invited to do so, and his submission consisted essentially of abusive statements rather than a legal reasoning. The court held that the complaint manifestly failed to meet the reasoning requirements of Art. 42(2) BGG and could therefore be rejected in summary proceedings under Art. 108 BGG. No court costs were imposed.

Omnilex headnote

Art. 42 Abs. 2 BGG, Art. 108 BGG; requirements for admissibility of a federal complaint and summary non-entry decision. A complaint must contain a legal argument directed against the contested decision and explain, with reference to the considerations challenged, why it is unlawful; purely polemical or insulting statements do not satisfy the duty to state reasons. If the pleading is manifestly unsubstantiated, the court may decline to enter the matter in summary proceedings under Art. 108 BGG. Exceptionally, costs may be waived.

Urteil vom 6. April 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Einstellung der Untersuchung,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 29. Januar 2010.
Der Präsident zieht in Erwägung:

1.

2.
Ausnahmsweise kann auf eine Kostenauflage verzichtet werden.

Demnach erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.
