Omnilex summary

The Federal Supreme Court did not enter into the criminal appeal because the appellant failed to pay the required cost advance of CHF 2,000 despite an extension and a final warning. The court held that Art. 62 BGG applies even in allegedly minor cases and that there was no reason to waive the advance. Court costs of CHF 800 were charged to the appellant under Art. 66(1) BGG.

Omnilex headnote

Art. 62 BGG; cost advance and non-entry for non-payment; Art. 66 Abs. 1 BGG; if the court orders a cost advance and the appellant does not pay it within the set deadline despite a grace period and warning, the appeal is not entered into under Art. 108 BGG. The duty to advance costs also applies in minor cases; a request to dispense with the advance is irrelevant absent a legal basis. Costs are borne by the appellant when non-entry is pronounced (consid. 1-2).

Urteil vom 28. Juni 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Schwyz, Postfach 1201, 6431 Schwyz,
Beschwerdegegnerin.

Gegenstand
Einfache Verletzung der Verkehrsregeln,

Beschwerde gegen den Beschluss des Kantonsgerichts des Kantons Schwyz, 2. Rekurskammer, vom 28. Februar 2011.

Der Einzelrichter zieht in Erwägung:

1.

Rekurskammer, schriftlich mitgeteilt.

Extracted holding

The court could not enter into the appeal because the advance payment was not made within the prescribed deadline.

Extracted reasoning

The appellant was twice reminded and expressly warned that failure to pay would result in non-entry. Art. 62 BGG applies even to minor cases, so there was no basis to waive the advance.

Key legal question

Allocation of court costs

Extracted holding

Court costs were imposed on the appellant.

Extracted reasoning

As the appeal was not entered into, the costs had to be borne by the appellant under Art. 66(1) BGG.
