Omnilex summary

The appellant filed a complaint without attaching the challenged decision. The Federal Supreme Court gave him a deadline to cure the defect under Art. 42(5) BGG, warning that the filing would otherwise be disregarded. He did not respond. The Criminal Division therefore did not enter into the complaint under Art. 108 BGG and exceptionally waived court costs.

Omnilex headnote

Art. 42 Abs. 5 BGG, Art. 108 BGG; non-entry for failure to cure a formal defect: where the appellant omits the challenged decision and does not remedy this defect within the court-fixed deadline after warning, the complaint is left out of consideration. If the formal deficiency is not cured, the court may issue a non-entry decision without examining the merits; a cost waiver remains exceptional and depends on the circumstances.
