Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint against the Lucerne cantonal appellate decision. The appellant did not address the decisive question whether the newly submitted witness certificate could alter the finding of misconduct, and his submission was merely appellatory. As a result, the complaint was inadmissible under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 108 BGG; admissibility of a criminal complaint against a cantonal revision decision: where the appellant does not engage with the decisive issue identified by the cantonal court and merely advances appellatory criticism, the complaint is not entered into. The Federal Supreme Court reviews only properly reasoned grievances capable of showing error in the challenged reasoning; a mere assertion that new evidence should lead to a different result is insufficient (consid. 1). Costs follow the outcome under Art. 66 Abs. 1 BGG.

Urteil vom 14. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Luzern, Zentralstrasse 28, 6002 Luzern.

Gegenstand
Verkehrsregelverletzung; Revision,

Beschwerde in Strafsachen gegen den Entscheid des Obergerichts des Kantons Luzern, II. Kammer, vom 11. April 2007.

Das Präsidium zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, der Staatsanwaltschaft des Kantons Luzern und dem Obergericht des Kantons Luzern, II. Kammer, schriftlich mitgeteilt.

Extracted by Omnilex

Key legal question

Whether the criminal complaint was sufficiently reasoned to challenge the cantonal decision on revision and new witness evidence.

Extracted holding

No. The complaint did not address the decisive question whether the new witness certificate could change the result; it was merely appellatory and therefore inadmissible.

Extracted reasoning

The Federal Supreme Court held that the appellant failed to engage with the only relevant issue identified by the cantonal court. Purely appellatory criticism does not satisfy the admissibility requirements, so there was no basis for substantive review under Art. 108 BGG.

Key legal question

Allocation of court costs.

Extracted holding

The court costs had to be borne by the appellant.

Extracted reasoning

Because the complaint was not entered into, the losing party was charged with the fees under the Federal Supreme Court Act.
