Omnilex summary

X. filed a federal criminal-law complaint for denial of justice against the Fribourg cantonal court after challenging the refusal of conditional release. Once the cantonal court decided the matter on 16 March 2012, X. withdrew his federal appeal and asked for costs. The Federal Criminal Court took note of the withdrawal, struck the case from the docket, ordered no judicial fees, denied party compensation, and held the legal-aid request moot.

Omnilex headnote

Art. 32 al. 2 LTF, Art. 66 al. 2 and 3 LTF, Art. 68 al. 4 LTF; withdrawal of the appeal and procedural costs: where an appeal is withdrawn, the Federal Court takes note thereof and strikes the case from the docket. As a rule, no judicial fees are levied in such a situation, while party costs are denied if the withdrawal rendered the proceedings unnecessary or caused avoidable costs. A request for legal aid becomes moot once no further decision on the merits is required (consid. 1).
