6B_152/2008 ΓÇó No standing and insufficient reasoning in criminal complaint
6B_152/2008Federal Supreme Court / Criminal DivisionMar 5, 2008Inadmissible
The Federal Supreme Court did not enter into the criminal complaint against the Canton of Zurich public prosecutor’s office concerning the opening of an investigation against officials and civil servants. It held that the complainant, as a reporting party and injured person, lacked standing, and that the appeal was in any event plainly insufficiently reasoned. Court costs of CHF 800 were imposed on her.
Art. 81 Abs. 1, Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; standing and reasoning requirements for a criminal complaint before the Federal Supreme Court. A mere reporting party or injured person is not entitled to appeal absent the conditions of Art. 81 Abs. 1 BGG. Independently thereof, a federal complaint must set out, in a manner complying with Arts. 42(2) and 106(2) BGG, why the contested decision infringes federal law; manifestly unsubstantiated submissions justify non-entry in summary procedure under Art. 108 BGG. Costs may be charged to the unsuccessful appellant under Art. 66(1) BGG.
