Omnilex summary

The Federal Supreme Court held that the appellant could not raise alleged bias of the cantonal judges for the first time before it, because he should have sought recusal earlier. It further held that he lacked standing to challenge the refusal to open criminal proceedings on the merits, since he complained only of patrimonial harm and was not a victim under the LAVI. The appeal was therefore inadmissible. Legal aid was refused because the appeal was hopeless, and reduced court costs of CHF 500 were imposed on the appellant.

Omnilex headnote

Art. 5 al. 3 Cst.; Art. 64 al. 1, Art. 66 al. 1, Art. 108 al. 1 let. a LTF; standing to appeal against a refusal to open criminal proceedings. A party forfeits the right to complain before the Federal Supreme Court of a procedural defect that it knowingly failed to invoke before the authority capable of remedying it, in particular a challenge to judicial impartiality raised for the first time on appeal. A complainant who alleges only patrimonial loss and not direct injury to physical, psychological or sexual integrity is not a victim under the LAVI and lacks standing to attack the merits of a refusal to prosecute; federal standing exists only for denial of the right to lodge a complaint in non-official offenses or for independent formal rights violations. Manifestly hopeless appeals justify denial of legal aid and imposition of costs, with reduction allowed for financial hardship.

Arrêt du 11 février 2010
Cour de droit pénal

Composition
M. le Juge Favre, Président.
Greffier: M. Oulevey.

Parties
X.________,
recourant,

contre

Ministère public de l'État de Fribourg, 1700 Fribourg,
intimé.

Objet
Refus d'ouvrir l'action pénale,

recours contre l'arrêt 502 2009-334 du Tribunal cantonal fribourgeois, Chambre pénale, du 4 janvier 2010.

Faits:

A.
X.________ a porté plainte pénale contre divers magistrats fribourgeois.

Favre Oulevey

Extracted by Omnilex

Key legal question

Whether the allegation of bias of the cantonal judges, raised only before the Federal Supreme Court, is admissible

Extracted holding

The objection is inadmissible because the appellant should have sought recusal at the cantonal level as soon as he knew the court composition.

Extracted reasoning

A party must act in good faith and cannot keep a procedural defect in reserve; a procedural violation that could have been remedied earlier is forfeited if not raised in time.

Key legal question

Whether the appellant has standing to challenge the refusal to open criminal proceedings on the merits

Extracted holding

He lacks standing on the merits because he alleges only patrimonial harm and is therefore not a victim within the meaning of the LAVI and Art. 81 para. 1 let. b ch. 5 LTF.

Extracted reasoning

Absent direct injury to physical, psychological, or sexual integrity, a complainant is not a procedural victim and may only appeal on limited formal grounds or on a wrongful denial of the right to file a complaint in non-official prosecutions.

Key legal question

Whether the request for legal aid should be granted

Extracted holding

Legal aid is denied because the appeal had no prospect of success.

Extracted reasoning

Since the claims were manifestly without merit, the statutory condition of non-frivolousness was not met.

Key legal question

Allocation of court costs

Extracted holding

Court costs of CHF 500 are imposed on the appellant, reduced in light of his financial situation.

Extracted reasoning

As the appeal failed, the appellant bears the costs under the Federal Supreme Court Act, with a reduction for financial hardship.
