Omnilex summary

The Federal Supreme Court held that the appellant's submission did not address the formal reasons for which the cantonal court had refused to enter into his remedy. Because the complaint failed to meet the reasoning requirements of Art. 42(2) BGG, the Court did not examine the merits or the cantonal alternative reasoning. The complaint was not entered into under Art. 108 BGG. Court costs of CHF 500 were imposed on the appellant, with his financial situation taken into account.

Omnilex headnote

Art. 42 Abs. 2 BGG; Art. 108 BGG; inadmissibility for insufficient reasoning: a complaint must engage with the decisive grounds of the challenged decision and, where several independent grounds are given, must attack each of them. If the appellant omits the formal reasons supporting a cantonal non-entry decision, the Federal Supreme Court cannot examine the merits or any alternative reasoning and will not enter into the complaint in summary proceedings under Art. 108 BGG. Costs are governed by Art. 66 Abs. 1 BGG and may be reduced under Art. 65 Abs. 2 BGG in light of the party's financial circumstances.

Urteil vom 7. Januar 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Polizei- und Militärdirektion des Kantons Bern, Kramgasse 20, 3011 Bern,
Beschwerdegegnerin.

Gegenstand
Verweigerung der bedingten Entlassung,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Bern, Strafabteilung, 2. Strafkammer, vom 27. November 2013.

Das Bundesgericht zieht in Erwägung:

1.

3.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Bern, Strafabteilung, 2. Strafkammer, schriftlich mitgeteilt.

Key legal question

Whether the federal complaint met the reasoning requirements and could challenge the cantonal non-entry decision.

Extracted holding

No. The filing did not address the decisive formal reasons for the cantonal non-entry and therefore failed to satisfy Art. 42(2) BGG.

Extracted reasoning

The appellant did not engage with the two grounds on which the cantonal court refused to hear the case, so the Federal Supreme Court could not review the merits or the alternative reasoning.

Key legal question

Allocation of court costs.

Extracted holding

Costs were imposed on the appellant, taking his financial situation into account.

Extracted reasoning

As the complaint was unsuccessful, the ordinary cost rule applied; the amount was moderated in view of the appellant's financial circumstances.
