Omnilex summary

The Federal Supreme Court did not enter into the criminal complaint against the Thurgau cantonal appellate decision, which had refused to hear an appeal because the declaration of appeal had been filed too late. The appellant invoked personal and business burdens, but he neither substantiated nor documented those assertions sufficiently. The court held that the filing lacked adequate reasoning and therefore was inadmissible under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Omnilex headnote

Art. 108 BGG; inadmissibility for insufficient reasoning of a complaint against a cantonal non-entry decision. A party contesting a refusal to hear an appeal must set out in a concrete and substantiated manner why the procedural deadline was complied with or why its non-compliance should be excused; mere unparticularized assertions do not satisfy the federal reasoning requirement. If the complaint does not engage with the decisive grounds of the cantonal decision and remains unsupported, the Court does not enter into the matter. Costs are borne by the unsuccessful party under Art. 66 Abs. 1 BGG.

Urteil vom 28. Januar 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Generalstaatsanwaltschaft des Kantons Thurgau, Zürcherstrasse 323, 8510 Frauenfeld,
Beschwerdegegnerin.

Gegenstand

Key legal question

Whether the complaint against the cantonal non-entry decision met the Federal Supreme Court's reasoning requirements.

Extracted holding

No. The appellant did not substantiate or prove the asserted reasons for missing the deadline, so the filing lacked sufficient reasoning.

Extracted reasoning

The alleged workload and private difficulties were merely asserted. Because the complaint did not develop or document these claims, the court could not examine them and the filing was inadmissible under Art. 108 BGG.

Key legal question

Who bears the court costs of the Federal Supreme Court proceedings?

Extracted holding

The appellant must bear the court costs.

Extracted reasoning

As the complaint was not entered into, the costs were imposed on the unsuccessful appellant.
