Omnilex summary

X.________ GmbH filed a constitutional complaint against a decision of the Bern appellate court in a definitive debt enforcement matter. In a later letter, it stated that it did not want the Federal Supreme Court to deal with the dispute and that the matter should not be treated as a constitutional complaint. The Federal Supreme Court construed this as an implied withdrawal, discontinued the proceedings, and did not charge court costs due to the special circumstances.

Omnilex headnote

Art. 32 Abs. 2 BGG, Art. 71 BGG i.V.m. Art. 73 BZP; withdrawal of a constitutional complaint and discontinuance of proceedings. A submission may be construed as an implicit withdrawal where, assessed objectively, the party clearly expresses that it does not wish the Federal Supreme Court to deal with the matter. In such a case, the single judge or competent division president may strike the case from the roll without further substantive examination. Costs may exceptionally be waived if special circumstances so justify; any request for an advance becomes moot upon discontinuance (consid. 1-2).

II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________ GmbH,
Beschwerdeführerin,

gegen

Z.________,
Beschwerdegegnerin.

Gegenstand
Definitive Rechtsöffnung.

Verfassungsbeschwerde gegen den Entscheid vom 15. Dezember 2010 des Obergerichts des Kantons Bern (Appellationshof, 1. Zivilkammer).

Nach Einsicht:
in die (als Verfassungsbeschwerde entgegengenommene) Eingabe vom 13. Januar 2011 gegen den Entscheid vom 15. Dezember 2010 des Obergerichts des Kantons Bern,
in das nachträgliche Schreiben der Beschwerdeführerin vom 27. Januar 2011,

in Erwägung:

Key legal question

Whether the constitutional complaint should be treated as withdrawn and the proceedings discontinued.

Extracted holding

The complainant's later letter was construed as a withdrawal of the complaint, so the proceedings were struck off the list.

Extracted reasoning

The wording of the subsequent letter showed that the complainant did not want the Federal Supreme Court to deal with the matter and did not want it treated as a constitutional complaint; this amounted to an implied withdrawal.

Key legal question

Whether court costs should be imposed on the complainant after withdrawal.

Extracted holding

No costs were imposed on the complainant.

Extracted reasoning

Given the special circumstances of the case, the court refrained from allocating costs; the advance on costs became moot.
