Omnilex summary

The complainant challenged the Thurgau cantonal appellate decision by constitutional complaint. After failing to pay the CHF 800 advance even within the extended deadline, and failing to prove timely payment, the Federal Supreme Court held that the complaint could not be entered into. The President therefore issued a non-entry judgment and charged the complainant CHF 300 in court costs.

Omnilex headnote

Art. 62 Abs. 3 and Art. 108 Abs. 1 lit. a BGG; non-payment of the required advance leads to non-entry on the appeal/complaint if the party does not comply within the extended deadline and does not furnish the required proof of timely payment. The failure to meet the advance-payment obligation after warning is a procedural deficiency that precludes consideration of the merits; costs are ordinarily imposed on the unsuccessful party under Art. 66 Abs. 1 BGG (consid. 1).

Gegenstand
Definitive Rechtsöffnung,

2009.

in Erwägung,

Extracted by Omnilex

Key legal question

Whether the constitutional complaint could proceed despite non-payment of the court advance within the set deadline.

Extracted holding

No; the complaint was not admitted because the advance was neither paid nor properly proven within the extended time limit.

Extracted reasoning

After the deadline extension, the complainant still did not deposit the CHF 800 with the Federal Supreme Court cashier, pay it at a post office to its credit, or provide the required debit confirmation. Under the warning previously given, non-entry followed.

Key legal question

Allocation of court costs following non-entry.

Extracted holding

The complainant had to bear the court costs of CHF 300.

Extracted reasoning

Because the complaint could not be heard due to failure to pay the advance, costs were imposed on the complainant pursuant to the Federal Supreme Court Act.
