Omnilex summary

X. challenged a Geneva cantonal judgment concerning provisional lifting of opposition for CHF 79. The Federal Tribunal held that the filing had to be treated as a subsidiary constitutional complaint because the value in dispute was below CHF 30,000 and no legal question of principle was invoked. It further found that the appellant did not allege any constitutional-right violation with the required substantiation. The complaint was therefore inadmissible, and CHF 50 in court costs were charged to the appellant.

Omnilex headnote

Art. 74 al. 1 let. b, art. 116 and art. 117 LTF; subsidiäre Verfassungsbeschwerde und Rügeanforderungen. Where the value in dispute is below the statutory threshold and no legal question of principle is invoked, an appeal may be examined only as a subsidiary constitutional complaint. In such proceedings, only violations of constitutional rights may be reviewed, and only if they are expressly invoked and reasoned in conformity with the strict motivation requirements. A filing that merely remains unintelligible or fails to identify any constitutional ground is inadmissible under art. 108 al. 1 let. b LTF. Costs are borne by the unsuccessful party under art. 66 al. 1 LTF.

Arrêt du 24 décembre 2009
IIe Cour de droit civil

Composition
Mme la Juge Hohl, Présidente.
Greffière: Mme Aguet.

Parties
X.________,
recourante,

représenté par Me Michael Rudermann, avocat,

Objet
mainlevée d'opposition,

recours constitutionnel contre l'arrêt de la
1ère Section de la Cour de justice du canton
de Genève du 24 septembre 2009.

considérant:
que, par arrêt du 24 septembre 2009, la Cour de justice du canton de Genève a déclaré irrecevable, subsidiairement mal fondé, l'appel interjeté par X.________ contre un jugement rendu le 11 juin 2009 par le Tribunal de première instance de Genève rejetant sa requête de mainlevée provisoire portant sur une somme de 79 fr.;
que l'intéressée interjette un recours au Tribunal fédéral contre cet arrêt;
que son recours doit être traité en tant que recours constitutionnel subsidiaire, dès lors que la valeur litigieuse est inférieure à 30'000 fr. (art. 74 al. 1 let. b LTF) et que la recourante ne soutient pas qu'on soit en présence d'une question juridique de principe (art. 74 al. 2 let. a LTF);
que seule la violation des droits constitutionnels peut être invoquée dans le cadre du recours constitutionnel (art. 116 LTF);
que, saisi d'un tel recours, le Tribunal fédéral ne connaît de la violation de droits fondamentaux que si ce grief a été invoqué et motivé par le recourant (art. 106 al. 2, par renvoi de l'art. 117 LTF), les exigences de motivation correspondant à celles de l'art. 90 al. 1 let. b aOJ (ATF 133 III 439 consid. 3.2 p. 444);
que, en l'espèce, le recours ne satisfait aucunement à ces exigences, la recourante n'invoquant, dans la mesure où son recours est compréhensible, la violation d'aucun droit constitutionnel;
que, dès lors, le recours doit être déclaré irrecevable (art. 108 al. 1 let. b LTF), aux frais de son auteur (art. 66 al. 1 LTF);
que le présent arrêt relève de la compétence du juge unique (art. 108 al. 1 LTF);

par ces motifs, la Présidente prononce:

1.
Le recours est irrecevable.

2.
Les frais judiciaires, arrêtés à 50 fr., sont mis à la charge de la recourante.

3.
Le présent arrêt est communiqué aux parties et à la 1ère Section de la Cour de justice du canton de Genève.

Extracted by Omnilex

Key legal question

Whether the federal appeal could be treated as a subsidiary constitutional complaint.

Extracted holding

Yes; because the disputed amount was below CHF 30,000 and no point of principle was invoked, only the subsidiary constitutional complaint route was available.

Extracted reasoning

The value in dispute was below the statutory threshold and the appellant did not allege a legal question of principle.

Key legal question

Whether the complaint complied with the requirement to invoke and reason constitutional rights violations.

Extracted holding

No; the filing did not identify any constitutionally protected right and failed to meet the strict motivation requirements.

Extracted reasoning

In a constitutional complaint, only violations of constitutional rights may be raised, and they must be expressly alleged and substantiated; this was not done here.

Key legal question

Whether the appeal was admissible.

Extracted holding

No; it was inadmissible.

Extracted reasoning

Because the pleading failed to satisfy the constitutional-motivation requirements, the court had to declare it inadmissible under the LTF.

Key legal question

Allocation of federal court costs.

Extracted holding

Court costs of CHF 50 were charged to the appellant.

Extracted reasoning

Costs follow the inadmissibility outcome and are borne by the losing party.
