Omnilex summary

The Federal Tribunal noted that, by a same-day judgment, it had admitted the appellant's connected public-law appeal. As a result, the reform appeal against the Geneva Administrative Tribunal judgment lost its object. The court declared the appeal moot and struck it from the roll. Because the appellant's filing had become unnecessary, she was ordered to pay a judicial fee of CHF 500. The respondent, who had acted without a lawyer, was not awarded party costs.

Omnilex headnote

Art. 40 OJ; art. 72 PCF: when a reform appeal loses its object because a related remedy has already been granted, the court declares the proceedings moot and strikes the case from the roll. Costs are charged to the party whose filing became unnecessary. A respondent who proceeds without counsel is, absent exceptional circumstances, not entitled to party costs (cf. ATF 113 Ib 353 consid. 6b).

Vu :

que, par arrêt de ce jour, la IIe Cour civile du Tribunal fédéral a admis, dans la mesure de sa recevabilité, le recours de droit public connexe de la recourante;

que le recours en réforme est dès lors devenu sans objet;

que, partant, il y a lieu de mettre les frais à la charge de la recourante, son procédé étant devenu inutile (art. 40 OJ et 72 PCF);
