Omnilex summary

A. appealed to the Federal Supreme Court against a cantonal supervisory decision concerning the remuneration of her former curator (CHF 6,000). The Federal Supreme Court held that the appeal did not contain comprehensible reasoning satisfying the requirements of Art. 42(2) and 106(2) BGG. It therefore dismissed the filing as inadmissible under the simplified procedure of Art. 108(1)(b) BGG. The court also waived judicial fees under Art. 66(1) BGG.

Omnilex headnote

Art. 42 al. 2 and 106 al. 2 LTF; admissibility of a federal appeal: the appeal must set out, in a clear and reasoned manner, how the challenged decision violates law, especially where qualified reasoning requirements apply. A merely appellatory or unintelligible submission does not satisfy these prerequisites and leads to non-entry under Art. 108 al. 1 let. b LTF. In such circumstances, the court may dispense with costs under Art. 66 al. 1 LTF where the case so warrants.
