Omnilex summary

The appellant withdrew her appeal by letter of 14 January 2011. The Federal Supreme Court therefore discontinued the proceedings by order of 18 January 2011. It refused to waive costs and ordered the appellant to pay court costs of CHF 300, noting that costs would in any event have been imposed because the appeal’s inadmissibility was foreseeable due to the absence of exhaustion of cantonal remedies.

Omnilex headnote

Art. 32 Abs. 2 BGG; Art. 71 BGG i.V.m. Art. 73 BZP and Art. 66 Abs. 1 BGG: withdrawal of an appeal leads to discontinuance of the proceedings by order of the presiding judge. Cost allocation follows the general rule that the withdrawing party bears the court costs; a waiver of costs is exceptional and may be denied where no special circumstances justify it. Costs may also be imposed where inadmissibility of the appeal was foreseeable, in particular for failure to exhaust cantonal remedies (consid. 1).

Gegenstand
Klage nach Art. 85a SchKG (Unterhalt).

Beschwerde nach Art. 72ff. BGG gegen das Urteil vom 17. August 2010 des Gerichtspräsidenten 2 des Gerichtskreises V Burgdorf-Fraubrunnen.

Nach Einsicht:
in die Beschwerde nach Art. 72ff. BGG gegen das Urteil vom 17. August 2010 des Gerichtspräsidenten 2 des Gerichtskreises V Burgdorf-Fraubrunnen,

in Erwägung:

3.

A withdrawn appeal is to be struck from the docket under Art. 32 para. 2 BGG and Art. 71 BGG in conjunction with Art. 73 BZP.

Key legal question

Who must bear the court costs after withdrawal of the appeal.

Extracted holding

The court costs were imposed on the withdrawing appellant.
