Omnilex summary

The Federal Supreme Court did not enter into X.________’s civil appeal against the Bernese Higher Court’s decision on debt enforcement/recognition of enforcement because he failed to pay the CHF 1,000 advance on costs within the extended deadline and did not provide proof of timely payment. The appeal was therefore rejected as inadmissible. The appellant was ordered to pay court costs of CHF 300.

Omnilex headnote

Art. 62 Abs. 3 BGG, Art. 108 Abs. 1 lit. a BGG; non-payment of the advance on costs after warning and expiry of the grace period leads to non-entry. If the advance is neither paid in cash nor duly evidenced as timely paid, the court must refuse to examine the appeal. The consequence of non-entry is the allocation of court costs to the defaulting appellant under Art. 66 Abs. 1 BGG (consid. 1).

Key legal question

Whether the appeal can be entered into despite non-payment of the court cost advance within the deadline.

Extracted holding

No. Because the advance was neither paid nor properly proven within the granted grace period, the court refused to hear the appeal.

Extracted reasoning

Under Art. 62(3) BGG, failure to pay the requested advance of costs after warning leads to non-entry; the same follows here under Art. 108(1)(a) BGG.

Key legal question

Who bears the court costs of the federal proceedings?

Extracted holding

The appellant bears the court costs.

Extracted reasoning

As the appeal was not entertained due to the appellant's default, costs were imposed on him under Art. 66(1) BGG.
