Omnilex summary

The appellant challenged a decision in a protective custody matter, but filed the Federal Supreme Court appeal by fax. The Court held that such a filing form is not permitted and that the appellant, despite being warned and invited to cure the defect within the deadline, failed to submit a valid appeal. In simplified procedure, the President therefore did not enter into the matter. No court costs were levied.

Omnilex headnote

Art. 48 Abs. 1, Art. 42 Abs. 4 und Art. 108 Abs. 1 lit. a BGG; form of filing and non-entry on manifestly inadmissible appeal. Appeals to the Federal Supreme Court must be lodged only by hand delivery, Swiss Post, or electronic submission with recognized electronic signature. A faxed submission is ineffective and inadmissible. If the appellant is notified of the defect and does not cure it within the appeal period by filing a valid appeal, the Court shall not enter into the matter under Art. 108 Abs. 1 lit. a BGG in simplified procedure; the president is competent. Costs may be waived in such non-entry decisions.

Urteil vom 7. Oktober 2010
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Regierungsstatthalteramt Bern-Mittelland.

Gegenstand
Fürsorgerische Freiheitsentziehung,

Beschwerde nach Art. 72 ff. BGG gegen das Urteil vom 25. August 2010 des Obergerichts des Kantons Bern (Kantonale Rekurskommission für fürsorgerische Freiheitsentziehungen).

Nach Einsicht
in die Beschwerde gemäss Art. 72 ff. BGG gegen das Urteil vom 25. August 2010 des Obergerichts des Kantons Bern,

in Erwägung,

Extracted by Omnilex

Key legal question

Whether a fax-filed appeal to the Federal Supreme Court is admissible.

Extracted holding

No. Appeals must be filed in the legally prescribed form; fax submissions are inadmissible.

Extracted reasoning

The Court held that appeals may only be lodged by hand delivery, Swiss Post, or electronically with a recognized electronic signature. The appellant was warned and given the chance to submit a valid appeal within the deadline, but did not do so.

Key legal question

Whether the Court should enter into the appeal under Art. 108 para. 1 lit. a BGG.

Extracted holding

No entry was made because the appeal was manifestly inadmissible.

Extracted reasoning

Since no valid appeal was filed after notice of the defect, the simplified procedure under Art. 108 BGG applied and the President could decide not to enter into the matter.

Key legal question

Whether court costs should be charged.

Extracted holding

No court costs were imposed.

Extracted reasoning

The Court expressly waived court costs in the non-entry decision.
