Omnilex summary

The appellant challenged a cantonal decision concerning a representation guardianship for his daughter. The Federal Supreme Court held that the appeal filed on 10 June 2009 was late, since the 30-day deadline expired on 8 June 2009 after service of the cantonal judgment on 7 May 2009. The Court also noted that the appeal would in any event be insufficiently reasoned because it did not address the decisive cantonal reasoning. Proceeding under the simplified procedure, the presiding member declared the appeal inadmissible and ordered court costs of CHF 500 against the appellant.

Omnilex headnote

Art. 100 Abs. 1, Art. 45 Abs. 1 und Art. 108 Abs. 1 lit. a BGG; when the appeal deadline is missed, the Federal Supreme Court must not enter into the appeal. The time limit runs from service of the challenged decision and is extended where the last day falls on a weekend or public holiday. In summary proceedings under Art. 108 BGG, a manifestly inadmissible appeal is disposed of by the presiding member. Independently, an appeal is also inadmissible if it does not engage with the decisive reasoning of the cantonal judgment and does not show, by reference to that reasoning, why the decision violates federal law or constitutional rights (consid. 1).

Nach Einsicht
in die Beschwerde gemäss Art. 72ff. BGG gegen den Entscheid vom 22.
