Omnilex summary

The Federal Supreme Court held that the appeal against the Zurich High Court judgment of 15 February 2011 was filed far outside the 30-day deadline. Since the appellant's counsel had received the cantonal judgment on 17 February 2011 and the appeal was only handed to the post on 10 June 2011, the appeal was manifestly inadmissible. The court therefore did not enter into the matter and ordered no court costs. The appellant was informed that any challenge to the separate judgment of 12 May 2011 would be dealt with in another file.

Omnilex headnote

Art. 100 Abs. 1 and Art. 48 Abs. 1 BGG; appeal deadline and non-entry under Art. 108 Abs. 1 lit. a BGG: A federal appeal must be filed or handed to the postal service within 30 days of notification of the cantonal decision. If this time limit is missed, the appeal is manifestly inadmissible and the deciding judge may dispose of the case in the simplified procedure by non-entry. In such a case, no substantive review occurs; the order on costs depends on the simplified procedure applied in the individual case.

Urteil vom 16. Juni 2011
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Hohl, Präsidentin,
Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Psychiatrische Universitätsklinik Y.________.

Gegenstand
Zwangsmedikation (fürsorgerische Freiheitsentziehung),

Beschwerde nach Art. 72 ff. BGG u.a. gegen das Urteil vom 15. Februar 2011 des Obergerichts des Kantons Zürich (II. Zivilkammer).

Nach Einsicht
in die Beschwerde gemäss Art. 72 ff. BGG u.a. gegen das Urteil vom 15. Februar 2011 des Obergerichts des Kantons Zürich,

in Erwägung,
