Omnilex summary

The complainant withdrew his complaint against the supervisory decision of the Schwyz cantonal court concerning debt enforcement offices. The Federal Supreme Court therefore struck the proceedings from the list without examining the merits. It ordered court costs of CHF 200 against the complainant. The court also noted that supreme supervision over bankruptcy and debt enforcement matters is exercised by the Federal Council, not by the Federal Supreme Court.

Omnilex headnote

Art. 32 Abs. 2 BGG; withdrawal of a complaint renders the proceedings moot and permits striking the case off the docket by the competent chamber president. Under Art. 71 BGG in connection with Art. 73 BZP, the matter is closed without a merits decision; costs are borne by the withdrawing party pursuant to the applicable cost rules. The court further reiterates that, since the entry into force of the BGG, supreme supervision over debt enforcement and bankruptcy is vested in the Federal Council under Art. 15 Abs. 1 SchKG, not in the Federal Supreme Court.
