Omnilex summary

X.________ SA appealed against the judgment of the Vaud cantonal debt-enforcement and bankruptcy chamber. The Federal Supreme Court had previously rejected requests for free legal aid and installment payment of the advance of costs, then granted an additional time limit to pay CHF 700. The court registry confirmed that no payment or debit proof had been received. Since the advance of costs was not paid in time, the appeal was declared inadmissible and court costs of CHF 400 were charged to the appellant.

Omnilex headnote

Art. 62 al. 1 and 3 LTF, Art. 48 al. 4 LTF; failure to pay the advance of costs within the prescribed or extended time limit leads to inadmissibility of the appeal. If the advance is neither credited nor supported by timely proof of debit, the court may decide without entering into the merits under Art. 108 al. 1 let. a LTF; the procedural costs are borne by the party at fault pursuant to Art. 66 al. 1 LTF.

Objet
convocation (procédure de faillite),

recours contre l'arrêt de la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud, en qualité d'autorité supérieure de surveillance, du 26 février 2009.

Vu:
l'ordonnance présidentielle du 20 avril 2009, rejetant les requêtes de la recourante tendant à l'octroi de l'assistance judiciaire gratuite ou de la possibilité de payer l'avance de frais par mensualités, et l'invitant à verser une avance de frais de 700 fr. dans les 10 jours, conformément à l'art. 62 al. 1 LTF;
l'ordonnance présidentielle du 11 mai 2009, accordant à la recourante un délai supplémentaire de 10 jours pour payer l'avance de frais, conformément à l'art. 62 al. 3 LTF;
l'avis de la Caisse du Tribunal fédéral du 3 juin 2009, constatant que l'avance de frais n'a été ni payée ni créditée sur son compte postal et qu'aucune attestation de débit d'un compte postal ou bancaire correspondant au montant exigé ne lui est parvenue jusqu'à ce jour;

considérant:
que l'avance de frais n'ayant pas été versée dans le délai imparti (art. 48 al. 4 LTF), le recours doit être déclaré irrecevable (art. 62 al. 3 LTF), aux frais de son auteur (art. 66 al. 1 LTF);

par ces motifs, vu l'art. 108 al. 1 let. a LTF, la Présidente prononce:

1.
Le recours est irrecevable.

2.
Les frais judiciaires, arrêtés à 400 fr., sont mis à la charge de la recourante.

3.
Le présent arrêt est communiqué aux parties et à la Cour des poursuites et faillites du Tribunal cantonal du canton de Vaud.

Key legal question

Whether the appeal had to be entered into despite non-payment of the advance of costs

Extracted holding

No. Because the advance of costs was not paid within the time limit, the appeal was declared inadmissible.

Extracted reasoning

The court found that the advance had neither been paid nor credited, and no proof of debit had been received within the extended deadline; therefore the appeal was inadmissible under the Federal Supreme Court Act.

Key legal question

Who bears the court costs of the federal proceedings

Extracted holding

The costs of the federal proceedings are charged to the appellant.

Extracted reasoning

As the appeal was inadmissible due to the appellant's failure to pay the advance, costs were imposed on the party causing the proceedings.
